Before listing a product for sale in the European Union, determine whether GPSR applies, what role you hold in the chain, and which economic operator established in the EU is responsible. Then link the product to its manufacturer, to a type or batch identifier, to safety information, to warnings, and to the contact details required in a distance-selling listing. Also check sector-specific rules: GPSR does not replace CE marking, chemicals legislation or other texts. If the supplier does not allow you to identify the product, its manufacturer or the responsible person, do not publish the listing by filling in the fields with guesses.
Start with scope and role
The European General Product Safety Regulation sets a framework for covered consumer products. The European Commission's guidelines state that GPSR obligations have applied since 13 December 2024, and that a company's actual role determines its responsibilities.
A reseller may be a distributor for a product bought and resold unchanged, but become a manufacturer for a product marketed under its own name or brand. A fulfilment service may also hold a different role depending on the services it provides. So do not tick a generic "seller" box.
| Question | Example evidence | Why it's blocking |
|---|---|---|
| Which product? | type, batch, series or other identifier | organize traceability |
| Who made it? | documented name and contact details | identify the original operator |
| What is your role? | contract and physical flow | determine obligations |
| Who is responsible in the EU? | economic operator established in the EU | meet the applicable framework |
| What risks and warnings? | analysis, instructions, label | inform and act if a problem arises |
| What does the online listing show? | dated screenshot and published data | verify the distance sale |
Building a product evidence sheet
The internal record must not be limited to an image and an EAN. Keep the manufacturer, its address, the product identifier, the contact details of the responsible person when required, the instructions, warnings and languages, and the document version. Every value needs a source.
The GPSR guidelines explain that distance listings must provide accurate information about the manufacturer or its representative, a clear description of the product, and the relevant warnings or safety information. The exact presentation depends on the file; do not copy a template without checking the texts and the situation.
Documentation procedure:
1. Identify the product and the audience it is intended for. 2. Determine the applicable sector-specific regulations. 3. Qualify your role for the actual flow. 4. Identify the manufacturer and the operator responsible in the EU. 5. Obtain the relevant risk analysis, traceability and safety information. 6. Check the languages and the medium of the information. 7. Faithfully reproduce the necessary information in the online listing. 8. Organize incident, withdrawal and recall handling.
An address found on another storefront is not evidence. Use the manufacturer's documents, the relevant official registers, and the supply-chain contract.
Do not confuse GPSR with CE marking
CE marking applies only to categories covered by harmonized rules that require it. GPSR provides a general framework, with an interaction to check for each product. A visible CE mark does not exempt you from identifying the operators or ensuring traceability and safety.
The method in CE marking in arbitrage sourcing starts by identifying the sector-specific legislation. Avoid two opposite mistakes: requiring a CE mark on a product not covered by any text that prescribes it, or accepting a logo without a declaration or documentation when marking is actually required.
Chemicals, batteries, toys, electrical equipment, cosmetics or other families may fall under specific rules. The FBA dangerous goods check remains distinct from general safety obligations.
Checking the marketplace listing
A product page can be technically publishable while still being incomplete with respect to the required information. Check the state actually visible, not just the fields sent by a feed. Keep dated evidence of the listing and its associated documents.
Do not use automated text to invent a warning or translate an instruction without validation. A safety translation must preserve meaning and be checked by a competent person. If the supplier does not provide the language needed for the target market, the file must be treated as incomplete.
Amazon has a public compliance page stating that requirements can vary by product and country. It reminds sellers that they must carry out their own assessment. The marketplace tool is therefore an extra control layer, not legal advice.
Preparing post-listing actions
Compliance is not a one-off check. Log safety complaints, incidents, manufacturer communications, product changes and withdrawal decisions. The EUR-Lex summary of GPSR mentions cooperation and action obligations in case of a dangerous product, along with informing consumers and authorities depending on the situation.
Your log must connect the listing, the batch, the supplier and the affected customer without exposing that data in a public article. Test a blocking procedure: being able to stop the sale, identify the stock, and retrieve the documents.
Extended producer responsibility is yet another axis. The guide on EPR in France and Germany shows why product safety and end-of-life responsibility must not share a single verdict.
GPSR checklist before publishing
- The scope has been checked for the product.
- The actual economic role is documented.
- The manufacturer and its contact details are proven.
- The operator responsible in the EU is identified where required.
- The product carries a usable traceability identifier.
- Risks, instructions and warnings come from authorized sources.
- The necessary languages are checked.
- The online listing shows the relevant information.
- Sector-specific rules are checked separately.
- An incident, withdrawal and recall procedure exists.
What ArbitragePro+ could automate / what the seller must verify
The proposed checklist-gpsr specification could require the traceability fields, link each value to a document, and prevent publication when a required operator or warning is missing. It should never decide the legal role on its own or draft unvalidated safety information.
The seller must determine the scope, their role, the sector-specific texts, the documents and the languages, then consult a competent professional whenever the case is uncertain.
